Welcome to Elite Sales Operator. These Terms & Conditions ("Terms") govern your access to and use of the Elite Sales Operator software platform, the "Dual-Screen HUD," the "Armory" database, and all related content and services (collectively, "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use our Services.

1. ACCEPTANCE OF TERMS

By creating an account, initiating a trial, purchasing a subscription, or otherwise using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. You further acknowledge that you are using this tool for commercial, professional purposes (B2B Sales) and not as a consumer.

2. INTELLECTUAL PROPERTY & LICENSE

  • Our IP: All content within Elite Sales Operator, including the "HUD" interface, the source code, the AI prompting logic, the "Deep-Intel" research methodology, and the "Elite Sales Operator" brand, is the exclusive intellectual property of OVS LLC ("Company"). This content cannot be copied, reverse-engineered, reproduced, or distributed without our express written permission.

  • Your License: We grant you a limited, non-exclusive, non-transferable, and revocable license to use the Services for your personal professional sales activities.

  • Your Data: Any specific prospect data, custom scripts, or "Armory" configurations you input into the system remain your property. We do not claim ownership of your sales data.

3. ACCOUNT REGISTRATION & SECURITY

  • Single User License: Your subscription grants access for one (1) individual user. Sharing login credentials with a team or other individuals is a violation of these Terms and may result in immediate account termination.

  • Account Security: You are responsible for maintaining the confidentiality of your login information. You agree to notify us immediately of any unauthorized use of your account.

4. USER CONDUCT & PROHIBITED USE

To maintain the integrity of the platform, you agree NOT to:

  • Use the Service to harass, spam, or defraud any third party (including your prospects).

  • Attempt to "scrape" data or use automated bots to access the Services.

  • Reverse-engineer the AI logic or build a competing product using our proprietary workflow.

  • Input sensitive personal health information (PHI) or illegal content into the system.

5. FEES, SUBSCRIPTIONS, AND FREE TRIAL

  • 7-Day Trial: Your access to Elite Sales Operator begins with a 7-Day Trial. During this period, you have full access to the HUD and Armory.

  • Subscription Commencement: Unless you cancel your subscription before the end of the 7-day trial period, your monthly subscription will automatically begin, and you will be charged the stated monthly fee (e.g., $49.00/month or your specific offer rate) to your provided payment method.

  • Billing: Subscriptions are billed on a recurring monthly basis. You authorize us to charge your payment method until you cancel.

  • Cancellation: You may cancel your subscription at any time through your account settings or by emailing support. Cancellation is effective at the end of your current billing cycle.

6. REFUND POLICY (THE "MISSION ASSURANCE" GUARANTEE)

While standard monthly charges are non-refundable after the billing date, we offer the following satisfaction guarantee for new users:

  • 30-Day Satisfaction Guarantee: If you are a first-time user and are not satisfied with the results of the Services, you may request a full refund within 30 days of your initial charge.

  • After 30 Days: No refunds will be issued for partial months of service or for charges incurred after the 30-day window.

7. EARNINGS DISCLAIMER & NO GUARANTEES

  • No Income Guarantees: Elite Sales Operator is a tool, not a guarantee of income. We make no claims that using this software will result in a specific amount of commissions, bonuses, or closed deals. Your results depend entirely on your industry, your offer, and your individual work ethic.

  • Not Financial Advice: The "Commission Blueprint" and financial calculators provided in the tool are for estimation and planning purposes only.

8. LIMITATION OF LIABILITY

In no event shall [Your Company Legal Name] be liable for any direct, indirect, incidental, special, or consequential damages, including loss of profits, loss of data, or loss of employment, resulting from:

  1. Your use or inability to use the Services.

  2. Any technical failure or downtime of the Services.

  3. Any conduct or content of any third party (including prospects) encountered while using the Services.

We provide this software "as is" and "as available" without any warranties of any kind.

9. TERMINATION OF SERVICE

We reserve the right to terminate or suspend your access to our Services at our sole discretion, without prior notice, for any conduct that we believe violates these Terms, harms other users, or impacts the integrity of our API/AI connections.

10. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law provisions.
